This Privacy Policy (“Notice”) describes how Videotape Inc. and our subsidiaries and affiliates (collectively, “Videotape,” “we,” “us,” or “our”) handles the information we may collect from or about you, and our practices for collecting, using, maintaining and disclosing that information.

This Notice applies to information we collect when you visit our websites, applications, and other digital properties that link to this Notice (collectively, the “Website”), provide video and other survey responses as a respondent in our research studies, view our research reports as a customer, create and use a registered user Videotape account, participate in events and activities that Videotape may host, receive our service emails and marketing communications, and engage with Videotape’s accounts on social networks (collectively with the Website, the “Services”).

Please read this Notice carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not use our Website or our Services. By accessing or using our Website or our Services, you agree to this Notice. This Notice may change from time to time (see Changes to Our Privacy Notice). Your continued use of this Website or our Services after we make changes is deemed to be acceptance of those changes, so please check the Notice periodically for updates. 



SUMMARY

Videotape provides qualitative and quantitative market research services and analysis to customers. When you use our Services, you are participating in market research efforts, either (a) as a respondent providing your answers to research survey questions, and/or (b) as a customer viewing the results of a research study.

As described in more detail below, we seek to provide customers with as little personal information as possible about our respondents while still serving the needs of customers. The only types of personal information about respondents that we provide to our customers are (a) your video and audio likeness within the videos you record, (b) the city and state in which you live (c) the demographic and consumer attributes you’ve voluntarily provided about yourself, and (d) any information that you may share with us in the surveys you access through the Services.



CHILDREN UNDER THE AGE OF 18

We do not knowingly collect information from children under 18 years of age. No one under age 18 may provide any information on the Website or through our Services. If we discover that we have inadvertently collected personal information from a child under 18, we will delete such information promptly and take steps to restrict further access to our Services by that individual. PERSONAL INFORMATION WE COLLECT

Information you give us. Personal information that you may provide through the Services or otherwise includes:

  • Images, videos, and other content that you upload or submit to us through the Services, such as by participating on a panel, answering survey questions, sharing the contents of your screen, or uploading content, including pictures, video, captions and other text, audio, and metadata associated with those files;

  • Survey responses and other opinions and/or feedback you provide as a research respondent;

  • Sensitive personal information that we collect and process only with your explicit consent, and additional safeguards are in place to protect this data, including:

    • Demographic information you provide with any survey responses (including age, gender, zip code, ethnicity, race, and household income); 

    • Biometric information, specifically, video recordings you consent to provide as part of your survey response;

  • Contact information, such as your first name, last name and email address (but only if you provide it to us);

  • Communications, such as information you provide when you contact us with questions, feedback, or otherwise correspond with us online;

  • Marketing information, such as your preferences for receiving marketing communications and details about how you engage with them; or

  • Details of transactions you carry out through our Website or in connection with our Services and of the fulfillment of any purchase orders you may make (and for which you may be required to provide financial information);

  • Other information that you choose to provide but is not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

Information from third-party sources. We may combine personal information we receive from you with the personal information we obtain from other sources, such as:

  • Third-party platforms. If you choose to connect the Services to a third-party platform, such as when you register or log in to your Videotape account using a Google or Microsoft email account, we will collect the information shared by the platform, such as your username or handle, name, image, profile data, and other information. We will treat any information that you or the platform may provide to us in accordance with this Privacy Policy. When you visit or interact with our pages on one of those platforms, the platform provider’s privacy policy will apply to your interactions and their collection, use, and processing of your personal information.

  • Business partners, such as customers, joint marketing partners, joint venturers, and affiliates of such entities.

  • Public sources, such as publicly-available social media profiles, directories, and other third party sources.

Data collected automatically. We, our service providers, and our business partners may automatically log the following information about you, your computer or mobile device, and your activity over time on the Services and other online services:

  • Device data, such as your computer or mobile device operating system type and version number, manufacturer and model, browser type, screen resolution, IP address, unique identifiers, and general location information such as city or town. (We do not collect this data directly, but we have access to it from some of our service providers.)

  • Usage data (including data provided by Framer Analytics: (https://www.framer.com/academy/lessons/analytics), such as pages or screens you viewed on our Website, how long you spent on a page or screen, navigation paths between pages or screens, information about your activity on a page or screen or with our email communications, access times, and duration of access.

  • Cookies (including by Google Analytics: https://marketingplatform.google.com/about/analytics/), which are text files stored on a visitor’s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently and remembering your preferences, enabling functionality, helping us understand user activity and patterns, facilitating online advertising and measuring the effectiveness of our ads.

    • Users will be prompted to accept or manage cookies through a cookie consent banner upon first visiting the Website. This banner will explain the purposes for which cookies are used, and users will have the ability to customize their preferences.

  • Javascript libraries (including by HotJar: https://www.hotjar.com/), which are snippets of code within web pages that execute when certain actions take place.

  • Web beacons, also known as pixel tags or clear GIFs, which are typically used to demonstrate that a webpage or email was accessed or opened, or that certain content within it was viewed or clicked, typically to compile statistics about usage of websites and the success of marketing campaigns.

  • Software development kits, or SDKs, which are used to incorporate third-party computer code into our App that allows our third-party service providers or advertising partners to collect data directly from it for a variety of purposes, including to provide us with analytics regarding the use of the App, to integrate with social media, add features or functionality to our app, or to facilitate online advertising.



RESTRICTIONS ON THE USE OF YOUR BIOMETRIC DATA

Videotape surveys typically require that respondents give an on-camera answer to one more survey question as a condition of completing the survey. While these “selfie” video answers are being recorded, Videotape uses automated technology to confirm that respondents’ faces are visible on the screen (similar to a camera's viewfinder detecting if someone is in frame), and that their microphones are recording sound. 

However, Videotape does not: 

  • use facial recognition technology;

  • extract facial geometry or measurements;

  • create biometric templates; or,

  • verify identity through facial features.

Except for the Videotape research customer that paid for the survey you participated in, Videotape does not sell any of our respondents’ personal information, including video responses, to other third-parties.  

Videotape does not collect, store, or process biometric identifiers or biometric information as defined under Illinois BIPA, Texas CBBA, or similar laws. Our face visibility checks are purely technical validations that do not extract or analyze facial features.



HOW WE USE YOUR INFORMATION

We use information that we collect about you and that you provide to us for the following purposes (or as otherwise described to you in this Privacy Policy or at the time of collection):

Service delivery. We use your information to:

  • provide, operate, maintain, and improve the Services;

  • communicate with you regarding the Services, including by sending you Services announcements, technical notices, updates, security alerts, and support and administrative messages;

  • analyze and share your survey responses, videos and feedback with our customers, which information may be used by such parties for their marketing and advertising purposes;

  • understand your opinions, needs and interests, and personalize your experience with the Services;

  • provide support for the Services and respond to your requests, questions and feedback;

  • process your Services purchase orders (though we do not directly process any payment information, which is processed directly by a third-party payment processor); 

  • provide you with research reports as part of your Services purchase orders; 

  • fulfill any other purpose we may describe when information is provided; and

  • fulfill any other purpose with consent.

Research and development. We may use your personal information for research and development purposes, including to analyze and improve the Services and our business and develop other products and services. As part of these activities, we may create aggregated, de-identified or other anonymous data from the personal information we collect. We make personal information into anonymous data by removing information that makes the data personally identifiable to you. We may use this anonymous data and share it with third parties for our lawful business purposes, including to analyze and improve the Services.

Marketing. Videotape, our customers and other partners may include your information, including your video responses to our surveys, in marketing materials. If you request information from us, use the Services or participate in our surveys, promotions or events, we may send you Videotape-related marketing communications as permitted by law but will provide you with the ability to opt-out.

Compliance and protection. We may use your personal information to:

  • protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims);

  • audit our internal processes for compliance with legal and contractual requirements and internal policies;

  • enforce our User Agreement and other agreements with our customers;

  • protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft; or

  • comply with applicable laws, lawful requests and legal process, such as to respond to subpoenas or requests from government authorities.

Other purposes with your consent. In some cases, we will ask for your consent to collect, use or share your personal information for other purposes. For example, we may ask for your consent to send you marketing emails where required by law or to post your testimonial or endorsement.



HOW WE SHARE YOUR INFORMATION

We may share your information with the following parties and as otherwise described in this Privacy Policy or at the time of collection:

  • Subsidiaries and affiliates. We may disclose your personal information to our subsidiaries and corporate affiliates for use consistent with this Notice.

  • Our customers. We may share the personal information of respondents with our customers and partners. For example, when you participate in one of our surveys or provide us videos, we will disclose the information you provide to our customers. Please note that any personal information shared will be controlled by the receiving company and be subject to its own privacy policies.

  • Service providers and contractors. We may work with companies and individuals to help provide and operate the Services on our behalf (including Digital Ocean for data storage: https://www.digitalocean.com/). They are permitted to use your personal information only to help us operate the Services or our business as authorized under our contracts with them.

  • Artificial intelligence (AI) and machine learning (ML) models. We use encrypted application programming interfaces (APIs) to share the survey response data from our research respondents to AI/ML services for the purposes of unstructured data analysis. Please review our Artificial Intelligence Policy to learn more.

  • Professional advisors. We may disclose your personal information to professional advisors, such as lawyers, bankers, investment bankers, auditors, and insurers, where necessary in the course of the professional services they render to us.

  • Compliance and protection. We may disclose your personal information as we believe appropriate to government or law enforcement officials or private parties (a) for the compliance and protection purposes described above; (b) as required by law, lawful requests or legal process, such as to respond to subpoenas or requests from government authorities; (c) where permitted by law in connection with any legal investigation; and (d) to prosecute or defend legal claims.

  • Business transfers. We may sell, transfer or otherwise share some or all of our business or assets, including your personal information, in connection with a business deal (or potential business deal) such as a merger, consolidation, acquisition, reorganization or sale of all or substantially all of our assets, or in the event of bankruptcy.

  • For any other purpose disclosed by us at the time you provide the requested information, and with your consent. 



YOUR CHOICES

Access, delete or update your information. If you have a registered Videotape account, you can review and change your stored information by logging into the Website and visiting your account settings page. If you created your Videotape account using Single Sign-On (SSO) credentials (such as through Google or Microsoft), certain personal information associated with your account can only be updated through your SSO provider's settings. This includes information such as your primary email address, name, and other profile details managed by the SSO provider.

You may also get help reviewing, updating, correcting or deleting the personal information in your registration profile by logging into your account or emailing us at support@videotape.ai. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Opt-out processing time. Please understand that it may take us up to 15 days (or more in some instances) to process any opt out request and that even if you opt out of receiving promotional correspondence from us, we may still contact you in connection with your relationship, activities, transactions and communications with us. 

Opt-out of marketing communications. You may opt out of marketing-related emails by following the opt-out prompt in the email. You may continue to receive Services-related and other non-marketing emails.

Advertising choices. We do not control third parties’ collection or use of your information to serve interest-based or behavioral advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way:

  • Browser settings. Blocking third-party cookies in your browser settings or using ad-blocking browser plug-ins/extensions. Many browsers accept cookies by default until you change your settings. If you do not accept cookies, however, you may not be able to use all functionality of the Services and our Website may not work properly for you. For more information about cookies, including how to see what cookies have been set on your browser and how to manage and delete them, visit https://allaboutcookies.org/.

  • Mobile device settings. Using your mobile device settings to limit the use of the advertising ID associated with your mobile device for interest-based advertising purposes.

  • Platform settings. Using Google’s and Facebook’s interest-based advertising opt-out features:

  • Ad industry tools. Opting out of interest-based ads from companies participating in the following industry opt-out programs:

The opt-out preferences described above must be set on each device or browser for which you want them to apply. Not all companies that serve interest-based ads participate in the ad industry opt-out programs described above, so even after opting-out, you may still receive some cookies and interest-based ads from other companies. If you opt-out of interest-based advertisements, you will still see advertisements online but they may be less relevant to you.

Do Not Track. Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. We currently do not respond to “Do Not Track” or similar signals. To find out more about “Do Not Track,” please visit ​http://www.allaboutdnt.com​.

Declining to provide your personal information. If you do not provide the information indicated as required or mandatory within the Services, or that is otherwise necessary to provide a requested service or feature within the Services, that portion or all of the Services may be unavailable to you, and if you have registered an account with Videotape we may delete it.

Third-party platforms or social media networks. If you choose to connect to the Services via a third-party platform, you may have the ability to limit the information that we may obtain from the third party at the time you log in to the Services using the third-party’s authentication service or otherwise connect your account. Subsequently, you may be able to control your settings through the third party’s platform or service. If you withdraw our ability to access certain information from a third-party platform or social media network, that choice will not apply to information that we have already received from that third party.



SECURITY

We have implemented measures designed to secure all personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information provided to us is stored on our secure servers behind firewalls. Any payment transactions will be encrypted or processed directly by a third-party payment processor.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website or access to our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. The information you share in any public areas of the Website may be viewed by any user of the Website.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website or through our Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

If you believe that your information has been accessed or acquired by an unauthorized person, you shall promptly contact us so that necessary measures can quickly be taken.

In the event of a data breach involving your personal information, Videotape will notify affected users as required by applicable law. We will provide details about the breach, including the types of information involved and any protective steps you can take.

TRANSFERRING YOUR DATA

We may transfer personal information that we collect or that you provide as described in this Notice to contractors, service providers, and other third parties we use to support our business (such as analytics and search engine providers that assist us with Website improvement and optimization) and who are contractually obligated to keep personal information confidential, use it only for the purposes for which we disclose it to them, and to process the personal information with the same standards set out in this Notice. 

We may process, store, and transfer your personal information in and to a foreign country, with different privacy laws. In these circumstances, the governments, courts, law enforcement, or regulatory agencies of that country may be able to obtain access to your personal information through the laws of the foreign country. Whenever we engage a service provider, we require that its privacy and security standards adhere to this Notice and applicable state privacy legislation. 

This Website is hosted in the United States. This Website may function in countries other than the United States. If you use the Website from outside the United States and submit your personal information or engage with the Website, you explicitly consent to the transfer, storage, or processing of your personal information in a country other than the United States where laws regarding processing of personal information may differ from the laws of other countries. You are responsible for compliance with the laws of the jurisdiction in which you choose to use the Website.

By submitting your personal information or engaging with the Website, you consent to this transfer, storage, or processing.  



DATA RETENTION

Except as otherwise permitted or required by applicable law or regulation, we will only retain your personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Personal data will be retained for up to 5 years after collection unless a longer retention period is required or permitted by law. After this retention period, we may anonymize your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent. 

In accordance with our routine record keeping, we may delete certain records that contain your information, including personal information, you have submitted to us. We are under no obligation to store such information indefinitely and disclaim any liability arising out of, or related to, the destruction of such information.



THIRD-PARTY SITES AND SERVICES

The Services may contain links to other websites and services operated by third parties, such as social media platforms, advertising services and other websites and applications. These links are not an endorsement of, or representation that we are affiliated with, any third party. We do not control third-party websites, applications or services, and are not responsible for their actions. Other websites and services follow different rules regarding their collection, use and disclosure of your personal information. We encourage you to read their privacy policies to learn more. 



NOTICE TO EUROPEAN RESIDENTS

If you are a citizen of the United Kingdom (“UK”) or the European Economic Area (“EEA” https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=LEGISSUM:member_states), in addition to the rights described within, you are also entitled to the following rights under the General Data Protection Regulation (“GDPR”): 

  • The right to access. You have the right to request us for copies of your personal data. We may charge you a small fee for this service.

  • The right to rectification. You have the right to request that we correct any information you believe is inaccurate. You also have the right to request us to complete the information you believe is incomplete.

  • The right to erasure. You have the right to request that we erase your personal data, under certain conditions.

  • The right to restrict processing. You have the right to request that we restrict the processing of your personal data, under certain conditions.

  • The right to object to processing. You have the right to object to our processing of your personal data, under certain conditions.

  • The right to data portability. You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.

The GDPR also gives you the right to lodge a complaint with a supervisory authority, in the European Union (or EEA) state where you work, normally live, or where any alleged infringement of data protection laws occurred. CALIFORNIA PRIVACY RIGHTS

When you use the Services, we may automatically collect personal information such as technical data about the device that you are using and your browsing patterns. We collect this information by using cookies, server logs and similar technologies. In some scenarios, such as when registering a Videotape account as a customer, you may choose to give us additional personal information, including things like your name, employer, address, email and telephone number. 

For respondents, we also collect the following information from you when you provide us with survey responses: (1) your video and audio likeness, (2) your demographic and consumer attributes, including your city and state, household income, age, gender, race and ethnicity, (3) information you voluntarily provide to us in your survey responses, and (4) inferences made based on items (1), (2), and (3). 

We use this personal information in several ways, including providing our services to our customers, monitoring website activity, and enabling you to communicate with us and request information.

We disclose (which may constitute a “sale” under California law) the following information to our customers: (1) your video and audio likeness, (2) your demographic and consumer attributes, including your city and state, household income, age, gender, race and ethnicity, (3) information you voluntarily provide to us in your survey responses, and (4) inferences made based on items (1), (2), and (3). 

Other than according to the foregoing sentence, we do not and will not sell the personal information that we collect from you through the Services,  as described in this Privacy Policy.

Under no circumstance do we sell the personal information of our respondents to any party other than our customers. Our customers use this information for general market research and related analysis.

We will not charge or penalize you for requesting information and otherwise exercising your rights as described in this Privacy Policy, but we may reasonably limit the number of requests you may make and impose appropriate charges as permitted by law.

In some instances, you may request that we delete your personal information, consistent with your general right to request that we, as a business, delete any of your personal information that we have collected from you. We will comply with your requests to the fullest extent allowed by applicable law.

If you use an authorized agent to request information or exercise your rights, that authorized agent must meet the same authentication requirements that apply to the requests that we may receive directly from you. We may verify requests made by authorized agents to ensure security and comply with regulations and our internal policies.

California residents have the right to request and obtain information about the sharing of their personal information by Videotape with third parties for direct marketing purposes. To make such a request, please contact us at privacy@videotape.ai.

Mandatory California privacy disclosures. 

We are required to make the following disclosures to comply with California law:

  • We collected the following categories of personal information in the last 12 months: characteristics of protected classifications under applicable law, internet or other electronic network activity information, geolocation data at the level of city and state, audio, electronic, visual or similar information and inferences drawn from the information above.

  • The sources of personal information we collected are: directly from you and from certain partners that operate the Services.

  • The business or commercial purpose of collecting the personal information above is described in more detail in the section of this Privacy Policy under the heading “How We Use Your Personal Information.”

  • We shared the information we collected with our customers. As defined by California law, this may mean that we “sold” the personal information we collected to our customers. Our business and commercial purpose of sharing or “selling” personal information is to allow our customers to have access to market research insights provided by you.

  • Right to Know. You have the right to request that we disclose to you the categories of personal information we have collected about you, as well as the sources of that personal information.   • Right to Delete. You have the right to request that we delete personal information we collect from you, subject to exceptions allowed by law.

  • Right to Correct. You have the right to request that we correct inaccurate personal information that we maintain about you, subject to exceptions allowed by law.

  • Right to Opt Out of Sale or Sharing. You have the right to “opt out” of the “sale” or “sharing” of your “personal information” to or with “third parties” (as each of those terms is defined by California law).

  • Right to Not Receive Discriminatory Treatment. You have the right to not be discriminated against on the basis of exercising the rights above.
